Police Association and City Manager Secretly-Negotiated Agreement

 

No automatic termination of process.

 

If Court ever orders records released, entire oversight process can be terminated.

 

Complainants and officers who had complaints filed against them may receive copies of investigative files in a ‘Monitor’s Conference.’

 

No complainant or officer or member of the Review Panel, or even the Monitor, can receive a copy of investigative files.

 

No limits on legally amending process.

 

Can ONLY be amended with the agreement of the Austin Police Association and City Manager

 

Limited public access to officer statements in the worst cases.

 

NO public access to or discussion of the officer's statement.

 

Citizens and other officers can use non-threatening process to file complaints.

 

Process only accepts complaints from citizens, not complaints by other officers.

 

City Council appoints Review Panel members to reflect the community.

 

The City Manager personally appoints Review Panel members.

 

Certain defined Public Information in the Monitor's Office open to the public.

 

ALL FILES in Monitor's Office closed to public, stiff criminal penalties for violation.

 

All Review Panel meetings conducted in public.

 

Review Panel deliberates and votes behind closed doors, but with police union board member present.

 

Review Panel has copy of entire investigation, so it can be studied, but cannot release certain limited parts to the public.

 

Citizens on Review Panel can only briefly "view" facts of investigation and Monitor has unlimited discretion to withhold any part of the investigation from Panel.

 

Monitor's Reports only limited by current law.

 

Monitor's Reports cannot refer to any specific case.  Monitor cannot discuss cases with the Austin City Council.
